1. Acceptance of Terms

By purchasing, downloading, installing, or using software offered through KillSwitch.in, you agree to these Software License & Purchase Terms, together with the applicable website Terms & Conditions and Privacy Policy.

Please read these terms carefully before purchasing. If you do not agree, do not purchase or use the software.

2. Software Products and Descriptions

KillSwitch.in may offer software products, custom-developed applications, scripts, integrations, utilities, and other digital products.

Each product listing will describe the product's intended functionality, included features, system requirements, deployment method, and any material limitations.

Customers should review the product description before purchasing. Features or services not expressly included in the product listing or a written agreement are not automatically included in the purchase.

3. Payment and Pricing

  1. The applicable purchase price will be displayed before payment.
  2. Unless expressly stated otherwise, the listed price covers the software license described in the product listing.
  3. Payments must be completed through the payment methods offered on KillSwitch.in.
  4. A purchase is considered confirmed after the payment has been successfully verified.
  5. Customers are responsible for providing accurate purchase and billing information.
  6. Applicable taxes will be charged or disclosed as required by law.

4. License Grant and Lifetime Access

Upon successful payment, KillSwitch.in grants the customer a non-exclusive, non-transferable license to use the purchased software in accordance with the applicable product description and these terms.

Where a product is advertised as providing lifetime access:

  • The customer receives a license without a recurring license subscription fee for the duration specified in the product listing or applicable license agreement.
  • The license covers the software version, features, deployment rights, and number of installations specified at purchase.
  • Lifetime access does not automatically include future major versions, additional products, paid integrations, ongoing development, or maintenance services unless expressly stated.
  • The term "lifetime" refers to the duration of the license as defined in the applicable product terms. It does not guarantee that a product, website, or business will operate forever.

Nothing in these terms limits any non-waivable rights the customer may have under applicable law.

5. Self-Hosted Software and Server Requirements

Where a product is intended to run on the customer's own server:

  1. The customer is responsible for providing and maintaining the required server, hosting, domain, network, and compatible infrastructure.
  2. Hosting charges, cloud-service charges, third-party API fees, database costs, and other external service expenses are the customer's responsibility unless otherwise agreed.
  3. The customer is responsible for server security, backups, access credentials, and protection of their own data.
  4. KillSwitch.in is not responsible for outages, data loss, or performance issues caused by the customer's hosting provider, server configuration, or third-party services, except to the extent liability cannot lawfully be excluded.
  5. Installation, migration, configuration, and troubleshooting assistance are included only where stated in the product listing or a written agreement.

6. Source Code and Intellectual Property

Unless expressly stated in writing, purchasing software grants a license to use the software and does not transfer ownership of its copyright, intellectual property, or source code.

Source code, editable project files, exclusive rights, resale rights, redistribution rights, and rights to create derivative products are included only if expressly specified in the applicable product listing or a separate written agreement.

Customers must not remove proprietary notices or claim ownership of intellectual property that has not been transferred to them.

7. Permitted Use and Restrictions

Customers may use purchased software for lawful purposes and within the scope of their license.

Unless expressly authorized in writing or permitted by applicable law, customers must not:

  • Resell, sublicense, redistribute, or publicly share the software.
  • Share license keys or activation credentials with unauthorized parties.
  • Copy, modify, reverse engineer, or create derivative works beyond the rights granted by the license.
  • Circumvent license verification, security mechanisms, or activation limits.
  • Use the software for unlawful activity, fraud, unauthorized access, or infringement of third-party rights.
  • Remove ownership notices or misrepresent the software as their own creation.

8. Updates, Maintenance, and Support

Updates, bug fixes, new features, server maintenance, and technical support are provided according to the package purchased.

A lifetime license does not, by itself, guarantee lifetime updates, lifetime technical support, continuous development, or compatibility with every future operating system, API, framework, or third-party service.

Any included support period, update entitlement, service-level commitment, or maintenance arrangement will be described in the applicable product listing or written agreement.

9. Refunds, Cancellations, and Failed Deliveries

Refund eligibility will be governed by the refund policy displayed at the time of purchase, the applicable product terms, and applicable law.

Customers should contact support if:

  • A payment succeeds but the software or license is not delivered.
  • The same payment is charged more than once.
  • The delivered product materially differs from its advertised description.
  • A material technical problem prevents the purchased software from functioning as described and cannot be reasonably resolved.

Refund requests will be reviewed based on the circumstances, the applicable policy, and legal requirements. Nothing in these terms removes statutory consumer rights or any mandatory refund or remedy available under applicable law.

10. License Suspension and Termination

KillSwitch.in may suspend or revoke a license where reasonably necessary due to verified payment fraud, unauthorized license sharing, material breach of these terms, or unlawful use.

Where appropriate, the customer will be notified and given an opportunity to remedy the issue before termination.

A license will not be revoked arbitrarily merely because the customer has purchased a lifetime license. Any suspension or termination will be subject to applicable law and the customer's contractual rights.

11. Third-Party Services

Software may depend on third-party APIs, libraries, hosting providers, payment services, or other external systems.

Such services may have their own terms, pricing, availability requirements, and usage restrictions. KillSwitch.in does not control independent third-party services and cannot guarantee their continued availability.

The customer is responsible for complying with the applicable terms of third-party services they use.

12. Warranties and Limitations

Software is provided according to its advertised specifications and any express warranties or commitments applicable to the purchase.

Except for express commitments and rights that cannot legally be excluded, KillSwitch.in does not guarantee uninterrupted operation, error-free performance, or compatibility with every environment.

To the extent permitted by law, KillSwitch.in will not be liable for indirect or consequential losses arising from the use of software. Any limitation of liability remains subject to applicable law and does not exclude liability that cannot legally be excluded.

13. Data Protection and Security

Customers are responsible for the personal data and business data they store or process using software deployed on their own infrastructure.

Customers must use appropriate security measures, maintain backups, protect credentials, and comply with applicable data-protection laws.

KillSwitch.in will handle customer information collected through its website, purchasing process, and support channels in accordance with its Privacy Policy and applicable law.

14. Changes to Products and Terms

Product features, pricing, and availability may change for future purchases.

Changes to these terms will be published on the website with an updated effective date. Changes will not automatically remove rights already granted under an existing purchase, except as permitted by the applicable agreement and law.

15. Governing Law and Disputes

These terms are governed by the laws of India, subject to applicable mandatory legal protections.

Disputes will be addressed through good-faith communication where practicable. Nothing in these terms prevents a customer from exercising a statutory right to approach a competent court, consumer commission, or other legally authorized forum.
